NeuroCraft is owned and operated by Freedom Coast Innovations ("we," "us," or "our"). By downloading, installing, or using NeuroCraft (the "App"), you agree to be bound by these Terms and Conditions (the "Terms"). If you do not agree, do not use the App.

1. Eligibility and Age Requirements

You must be at least 13 years old (or the age of digital consent in your region, if higher) to create an account or use the App's connected features. If you are under 18, you may only use the App with the consent and supervision of a parent or legal guardian, who agrees to these Terms on your behalf. Kids Mode (Section 10) is a feature a parent or guardian may enable on their own device and account for a child in their care.

2. Use of the App

NeuroCraft provides brain-training games, AI-generated quizzes and puzzles, progress tracking, and optional social features. You agree to use the App only for lawful purposes and in compliance with these Terms and all applicable laws and regulations, including export and sanctions laws.

3. Acceptable Use

You agree not to misuse NeuroCraft in any way, including but not limited to:

• Using bots, scripts, or automation tools to access the App or generate content • Attempting to reverse-engineer, decompile, scrape, or tamper with App features, level generation, or the AI content service • Attempting to manipulate scores, streaks, Neurons, leaderboards, duel results, or promo code redemptions • Circumventing, or attempting to circumvent, play limits, purchase requirements, or parental controls such as Kids Mode • Interfering with the operation or security of the App or its servers • Violating any applicable laws or the rights of any other user

Violation of this policy may result in suspension or termination of your access.

4. Accounts

NeuroCraft uses Sign in with Apple. You are responsible for maintaining the security of your Apple ID and for all activity that occurs under your account. Accounts are personal to you and may not be sold, transferred, or shared. You agree to notify us promptly if you suspect unauthorized access. You may delete your account and associated data at any time from within the App.

5. Subscriptions and Billing

NeuroCraft offers a free tier with limited game credits and optional auto-renewable Premium subscriptions (monthly and yearly) purchased through Apple In-App Purchase.

• Payment is charged to your Apple Account at confirmation of purchase. • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period; your account is charged for renewal within 24 hours prior to the end of the current period. • You can manage and cancel subscriptions in your Apple Account settings at any time. Cancelling stops future renewals; it does not refund the current period. • Prices may change; if they do, the change applies no earlier than your next renewal, and Apple will notify you as required. • All purchases are processed by Apple. All sales are final unless otherwise required by law; refund requests are handled by Apple through their standard process at https://reportaproblem.apple.com.

6. One-Time Purchases (Game Packs and Cosmetics)

The App may offer consumable one-time purchases (such as game-credit packs) and non-consumable purchases (such as avatar animals). Consumable credits are added to your account when the purchase completes, do not expire, and cannot be refunded once consumed except where required by law. Game credits have no monetary value, are not transferable, and may only be used within the App.

7. Promo and Offer Codes

We may issue promotional codes (redeemed inside the App) or App Store offer codes (redeemed through Apple). Codes have no cash value, may be limited to one redemption per person or device, may expire or be discontinued at any time, and may not be sold, transferred, or exchanged. We may revoke benefits obtained through fraudulent, automated, or abusive redemption.

8. Virtual Currency and Cosmetic Items

NeuroCraft includes a virtual currency ("Neurons") and virtual cosmetic items earned through gameplay. Neurons and cosmetics have no real-world monetary value, cannot be purchased with, exchanged for, or redeemed for real money or anything of value outside the App, and are not transferable. We may modify, rebalance, or discontinue virtual currency and items at any time. You receive only a limited, revocable license to use them within the App.

9. AI-Generated Content

Quizzes, questions, explanations, and other game content in NeuroCraft are generated by artificial intelligence. While we design the App to favor accurate, high-quality content, AI-generated material may occasionally contain errors, outdated information, or inaccuracies. NeuroCraft content is provided for entertainment and general educational enjoyment only and should not be relied upon as an authoritative source of facts or as professional, academic, legal, medical, or financial advice.

10. Kids Mode

Kids Mode is an optional feature that a parent or guardian can enable for a child using the parent's device and account. While enabled, social features are hidden, purchase interfaces are not shown, and gameplay draws from the account's existing game credits. Disabling Kids Mode requires the device owner's authentication (Face ID, Touch ID, or passcode). Kids Mode does not create a separate account for the child, and no additional personal information is collected from the child. The parent or guardian remains responsible for the account and all purchases on it.

11. No Health or Cognitive Claims

NeuroCraft is a game. It is not a medical device, therapy, or diagnostic tool, and we make no claims that using NeuroCraft will improve memory, intelligence, focus, academic performance, or any other cognitive ability, or that it can prevent, treat, or slow any cognitive condition. Any scores or metrics in the App (including the NeuroScore) are game statistics only, not clinical measurements. If you have concerns about cognitive health, consult a qualified healthcare provider.

12. Community Features and User Content

NeuroCraft may include optional social features such as friends, duels, and weekly leagues. Participation is completely optional and is not required to use the core functionality of the App.

Friend Connections. Users cannot be searched or discovered publicly within NeuroCraft. Connections only occur when users voluntarily share their private friend code or scan each other's QR code.

Content Visibility. Your username, avatar, and any stats you choose to share are only visible to users you have added as friends, subject to your sharing settings. You control what is shared globally and per friend.

User Conduct. Usernames and any user-provided text (such as quiz topics) must not be explicit, sexual, harassing, threatening, abusive, discriminatory, hateful, illegal, or otherwise offensive, and must not impersonate others or infringe anyone's rights. NeuroCraft filters usernames automatically and reserves the right to restrict access to community features or suspend accounts that violate these rules.

License to User Content. You retain ownership of text you enter (such as quiz topics), and you grant us a non-exclusive, worldwide, royalty-free license to use it to operate and improve the App (for example, to generate the content you requested).

Moderation and Enforcement. We reserve the right to remove content, restrict access to community features, or suspend accounts if behavior or content violates these guidelines or is deemed harmful to other users or the platform. Community features may be modified, limited, or discontinued at any time.

13. Intellectual Property and Feedback

All trademarks, logos, artwork, game designs, software, and content in NeuroCraft are owned by or licensed to Freedom Coast Innovations. You may not copy, reproduce, or modify the App's content without written permission. If you send us feedback or suggestions, you grant us the right to use them without restriction or compensation. If you believe content in the App infringes your intellectual property, contact us at the email in Section 23 with details and we will review promptly.

14. Third-Party Services

The App relies on third-party services, including Apple (In-App Purchase, Sign in with Apple, iCloud/CloudKit, Game Center) and an AI content provider. Their availability is outside our control, and their terms and privacy policies govern your use of their services. Links to external websites (including our own) are provided for convenience; we are not responsible for third-party sites.

15. App Availability, Updates, and Changes

We strive to keep NeuroCraft available but do not guarantee uninterrupted or error-free service, including availability of AI content generation, cloud sync, or social features. We may update, modify, add, remove, or discontinue features (including games, levels, boosts, and pricing of virtual items) at any time. Progress is synced through your private iCloud database where available, but we are not liable for lost progress, virtual currency, or virtual items resulting from service interruptions, device issues, sync conflicts, or account deletion.

16. Termination

We reserve the right to suspend or terminate your access to the App for violations of these Terms or other harmful conduct. You may stop using the App and delete your account at any time. Sections that by their nature should survive termination (including Sections 8, 13, and 17–21) survive.

17. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR AVAILABILITY. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

18. Limitation of Liability

To the fullest extent permitted by law, Freedom Coast Innovations is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of data, profits, or goodwill, resulting from your use of or inability to use the App, including reliance on AI-generated content or loss of virtual items, progress, or data. To the fullest extent permitted by law, our total aggregate liability for any claim relating to the App is limited to the greater of (a) the amount you paid us through the App in the 12 months before the claim arose, or (b) USD $50. Nothing in these Terms limits liability that cannot be limited by law.

19. Indemnification

You agree to indemnify and hold harmless Freedom Coast Innovations and its officers, employees, and agents from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the App, or your violation of any law or third-party right.

20. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida and the applicable federal laws of the United States, without regard to conflict-of-law rules. Before filing a claim, you agree to contact us at the email in Section 23 and attempt in good faith to resolve the dispute informally within 30 days. Any dispute that cannot be resolved informally shall be brought in the state or federal courts located in Florida, and you consent to their jurisdiction, except where your local consumer law provides otherwise. To the extent permitted by law, each party waives any right to a jury trial and agrees claims will be brought individually and not as part of a class action.

21. End User License Agreement (EULA) and Apple Terms

In addition to Apple's Standard End User License Agreement (EULA), accessible at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/, by downloading and using NeuroCraft you are granted a limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices that you own or control, for personal, non-commercial entertainment purposes only.

You agree not to:

• Modify, copy, reverse-engineer, or distribute the App • Use it for any commercial or unlawful purpose • Share your account or access with others

This license is granted solely for your personal use, and Freedom Coast Innovations retains all ownership rights to the software and content. We reserve the right to terminate this license if you fail to comply with these Terms.

Apple is not a party to these Terms and is not responsible for the App or its content, maintenance, support, or any product warranty. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. In the event of any conflict between these Terms and Apple's Standard EULA regarding your use of the App, Apple's minimum terms prevail. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.

22. Changes to These Terms

We may update these Terms from time to time. The "Effective Date" above reflects the latest version, and material changes will be communicated in the App or on our website. Continued use of the App after changes take effect constitutes acceptance of the updated Terms. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms, together with the Privacy Policy and Apple's Standard EULA, are the entire agreement between you and us regarding the App.
